Former Colorado elections clerk Tina Peters is asking the state appeals court to recognize Donald Trump’s pardon of her state convictions as valid.

In a motion Tuesday, Peters’ lawyers said the Colorado appeals court no longer has jurisdiction over her case because of a Dec. 5 pardon issued by Trump. They also asked the court to release her from prison because of the pardon.

Peters, the former Mesa County, Colorado clerk, was convicted of state crimes there for orchestrating a data breach scheme driven by false claims about voting machine fraud in the 2020 presidential race.

Trump’s pardon power does not extend to state crimes.

    We can’t allow him to pardon state crimes.

    He doesn’t have that authority and we don’t need to give him more.

    If this goes to the federal supreme court, I honestly don’t understand why the state would even recognize it. It’s not under federal jurisdiction so that even they don’t have a say in this unless the state decides to just accept it for some reason.

      Also, she assaulted the police officer when being arrested.

      She should be glad she’s a white lady, since some people get a knee on their windpipe for several minutes for just passing bad checks or selling loose cigarettes…this bitch not only tried to fuck with our election, but she tried to kick a cop when getting arrested.

      My hot take: She deserves to stay in jail cause she broke law and he and his team isn’t smart enough to know the lawful boundaries or they think they are above them and all must bend to their power.

    “Your lies are well-documented and these convictions are serious,” he said. “I am convinced you would do it all over again. You are as defiant a defendant as this court has ever seen.” He added that the damage she caused is “unmeasurable.”

    Barrett also called out Peters for lying when she demonstrated her infamous videotaped attempt to kick a police officer in 2022. That incident had nothing to do with her trial, but she included it in a litany of lies she said were part of the case against her.

    She bent over and kicked a leg in the air to show how having her arm pulled had caused that involuntary movement. Barrett called that assertion “preposterous.” There was tittering throughout the courtroom over her demonstration.

    the colorado courts should absolutely grant her request and officially recognize that she received a federal presidential pardon. and in the same ruling also take notice that the presidential power of the pardon does not apply to any state charged crimes and that she will remain in prison until the colorado governor commutes or pardons her sentence, she receives parole from a parole board, or she serves her sentence in full.
