

“I think it’s more likely than not that the state case goes away with the federal guilty plea,” said Anthony Capozzolo, a former prosecutor with the Manhattan District Attorney’s Office and a former federal prosecutor with the Eastern District of New York.
Capozzolo expects New York prosecutors will be blocked from moving ahead “because it’s likely both offenses will be punishing someone for the murder of the same victim and the elements of the federal and state cases are punishing the same harm or evil.”
“Therefore, the offenses will not be deemed different enough to allow New York to continue to prosecute the case,” he said.
